The case of Twin B involves the decision to send a newborn to a less intensive Level 2 special care nursery (SCN) than to the Level 3 neonatal intensive care unit (NICU) that is considered optimal by the physician. The physician’s acceptance of the transfer is against the child’s best interest and is due to parental convenience. In analyzing the case, we reject the best interest standard. Our rejection is partly supported by the views of Douglas Diekema, John Hardwig, (...) and Lannie Ross. Instead of the best interest standard, we offer and defend an approach we base on a microeconomic analysis of externalities, such as those involved with automobile emissions. This extends our previously presented general microeconomic approach to patient decision-making. It provides a clearer way to evaluate situations, like those of Twin B, in which burdens faced by family members may be used to determine the appropriate level of treatment for a decisionally incapable patient. Philosophers disagree, with some rare exceptions. One of those exceptions is the broadest-brush account of what language is. Language is a system of signs used for the communication of --well, and here the agreement begins to break down--thoughts, ideas, messages, propositions or propositional contents, intentions, and a host of technical terms offer themselves to chink the cracks. A list of philosophers subscribing would be impossible to complete. Locke, Carnap, Augustine, Hobbes, Fodor, Katz, Chomsky, Derrida, --well, and on and on. Easier (...) would be to list those who dissent. Heraclitus, Wittgenstein, maybe J.L. Austin, Frank Ebersole, and NOT on and on. The first chapter lays out the view that language is a system of signs in sympathetic terms. The second provides a selection of what are usually called “ordinary language” arguments against the view--reminders about how the view requires us to think in terms which are not consistent with how we think about language and signs when we are not doing philosophy. Those arguments have been unpersuasive among philosophers, and Chapter Three begins the work of investigating separate pieces of the view in detail. Chapter Three takes up an argument for the view which is familiar among philosophers, using Jerry Fodor’s formulation: we cannot be thinking in a public, natural language, because animals and preverbal infants think with no such language. I show this argument is not an argument at all but is rather an expression of the view in question. Chapter Four takes up the argument that the relations between particular words and their meanings is arbitrary or conventional rather than natural or necessary, otherwise there would be only one language among mankind. I argue that the alternatives (conventional vs. natural or necessary) are both generated by taking the division between words and their meanings to be the division between signs and signified--in other words, the question is a result of adopting the view of language as signs. Attempts to argue for the legitimacy of the question without taking the view for granted only serve to call it into question more. In Chapter Five I investigate whether we talk in order to communicate something which is otherwise hidden and invisible. We are tempted to think that you and I talk because I cannot read your mind or you mine. Though Wittgenstein has a famous set of comments on the notion of a private language, it remains a strong temptation to think that language gives public form to something (thoughts, ideas, intentions, feelings, content, meaning) which without language would be unknowable to all but the person whose something it is. Examples help point to the incoherence of this view and show that even if it were not incoherent, remedying the invisibility of those internal whatnots would still leave us with a need for language. Chapter Six takes up a hoary question about boundaries of effability--the possibility that there are limits to what can be said which are more restrictive than what can be thought or felt. The account of language as signs provides one easy way to make sense of this idea, but investigation into examples shows the problem is not one that makes sense unless we just grant that account. Chapter Seven investigates how to make sense of the notion that there are things which are in language and other things which are not. I spell out how the view of language as signs gives us a way to think this, and then show how one reaction to finding problems with the notion resonates with Wittgenstein’s early work and with some work of Jacques Derrida, who bite similar bullets and agree that everything is language, that the limits of language are the limits of our world. I then subject that reaction to critical investigation using examples, which reveals their reaction as a rear-guard attempt to save the view of language as signs. Chapter Eight uses examples as guides toward alternative views of language, feeling our way toward what language might be if it is not a system of signs. Finally, the appendix takes up what I take to be the serious arguments against the methods I use in this work, the first two articulated by John Searle (“the assertion fallacy”) and H. P. Grice (“conversational implicature”), and another the generally unspoken belief that philosophical work is like scientific work. (shrink)

In the relatively short time since 2006—when Theoretical Medicine and Bioethics published an issue on moral issues relevant to the use of nonhuman animals in research [1]—significant changes have occurred for nonhuman animals in many quarters. Public sentiment, new policy initiatives, and scientific studies of nonhuman animals’ capacities have all influenced the ways in which nonhuman animals are perceived and treated in research. Today, a large body of information is available for use in decision making about the acceptability of using (...) nonhuman animals in research. The articles in this issue assess how moral argument and empirical studies stand to guide animal research policies and practices in future years.Many in bioethics have come to regard issues of animal research as a subfield of research ethics, bringing it closer to human research ethics. This book presents a comprehensive theory of the ethics and political philosophy of public health surveillance based on reciprocal obligations among surveillers, those under surveillance, and others potentially affected by surveillance practices. Public health surveillance aims to identify emerging health trends, population health trends, treatment efficacy, and methods of health promotion--all apparently laudatory goals. Nonetheless, as with anti-terrorism surveillance, public health surveillance raises complex questions about privacy, political liberty, and justice both of and in data use. Individuals and groups can (...) be chilled in their personal lives, stigmatized or threatened, and used for the benefit of others when health information is wrongfully collected or used. Transparency and openness about data use, public involvement in decisions, and just distribution of the benefits of surveillance are core elements in the justification of surveillance practices. Understanding health surveillance practices, the concerns it raises, and how to respond to them is critical not only to ethical and trustworthy but also to publicly acceptable and ultimately sustainable surveillance practices. The book is of interest to scholars and practitioners of the ethics and politics of public health, bioethics, privacy and data technology, and health policy. These issues are ever more pressing in pandemic times, where misinformation can travel quickly and suspicions about disease spread, treatment efficacy, and vaccine safety can have devastating public health effects. Darwinism, Democracy, and Race examines the development and defence of an argument that arose at the boundary between anthropology and evolutionary biology in twentieth-century America. In its fully articulated form, this argument simultaneously discredited scientific racism and defended free human agency in Darwinian terms. The volume is timely because it gives readers a key to assessing contemporary debates about the biology of race. WRIGHT The publication of a new intellectual biography of George Cheyne1 provides a "propitious" occasion for "a thoroughly skeptical review"2 of the question which has long exercised Hume scholars, whether Cheyne was the intended recipient of David Hume's fascinating pie-Treatise Letter to a Physician,3 the (...) letter which describes his own hypochondriacal physical and mental symptoms and gives an account of his early philosophical development.4 Hume's nineteenth-century biographer, John Hill Burton, argued that Hume was probably writing to Cheyne,5 while Ernest Mossner claimed to definitively refute that hypothesis in an article entitled "Hume's Epistle to Dr. Arbuthnot," published in 1944.6 Anita Guerrini's intellectual biography does not discuss Cheyne as a possible recipient of Hume's letter, but she does present a well-rounded picture of this interesting eighteenth-century physician from which we can judge his appropriateness as its addressee. In the following discussion I will make use of the biographical material found in this new biography of Cheyne, as well as other sources, to show that Mossner's arguments are less than definitive, and that it would be wrong to dismiss the possibility that the letter was sent to George Cheyne.7 This is a possibility that, for reasons that I will make clear, makes good biographical and philosophical sense. At the same time, it is important to keep a proper suspense of judgment as Burton did, for the evidence that the letter was either intended for or actually sent to Cheyne is not definitive. John P. Wright Burton, who first published the autobiographical letter of the 22-yearold Hume in 1846, narrowed down the possible addressees of Hume's letter to either Cheyne or John Arbuthnot. He also pointed out that it is possible that the letter was never sent, and that the ten and a half page manuscript is only a neatly written draft, rather than a fair copy of an actual letter. Nevertheless, Burton thought he could identify the unnamed addressee on the basis of the internal evidence of the manuscript and the records of Scottish physicians practicing in England at the time. In the letter, Hume refers to the intended recipient as his "Countryman, a Scotchman [,]... a skilful Physician, a man of Letters, of Wit, of Good Sense, & of great Humanity."8 Further he writes that he is consulting him because he is a person "of great Learning beyond [his]... own Profession" who is acquainted with the "Motions of the Mind" he has described in his letter, and that "Fame pointed [him]... out as the properest person to resolve my Doubts..." about the cure of his disorder.9 Burton tells us that "the first name that suggested itself... was Arbuthnot, whose fine genius was just then flickering in the socket."10 (John Arbuthnot had been ill for some time, and died a year later.) But he then added that "a more full consideration showed to my satisfaction that it must have been destined for Dr. George Cheyne." His main reason for settling on Cheyne was that Cheyne's immensely popular The English Malady (1733) had recently been published, and that "there is a certain unison of tone between Hume's letter and this book." Burton quotes a portion of Cheyne's own long autobiographical account of his own disease in The English Malady. Cheyne's autobiography begins with the claim that "I passed my Youth in close study, and almost constant Application to the abstracted Sciences, (wherein my chief pleasure consisted) and consequently in great Temperance and a Sedentary Life"; it is followed by the reflection that any overindulgence in food or drink led to physical and psychological problems.11 He goes on to describe these in great detail for 39 pages, along with a history of his life. How far does a researcher’s responsibility extend when an incidental finding is identified? Balancing pertinent ethical principles such as beneficence, respect for persons, and duty to rescue is not always straightforward, particularly in neuroimaging research where empirical data that might help guide decision making are lacking. We conducted a systematic survey of perceptions and preferences of 396 investigators, research participants, and Institutional Review Board members at our institution. Cavafy (1863-1933) was not born a poet but became one only through persistence and labor, reaching his "first step" sometime after the midpoint of his life. In his effort to assess the quality of his earlier poetic production and sharpen his sensitivity in facing self-criticism, he decided to put in writing his (...) personal thoughts on his work sometime in 1903. The text was written in English in a personal shorthand Cavafy had devised for his own use. It was found among the papers he left to A. Sengopoulos and published for the first time in 1963 by M. Peridis, who also supplied the suitable title Ars Poetica. It falls outside the scope of this essay to discuss the antecedents of this document. Taken as a whole, the text has all the clarity and directness required of a testament designed to serve as a personal guide and handbook. The problems it discusses are limited to the needs of the poet. In this regard, the Ars Poetica has neither the range of topics nor the theoretical scope of, for instance, Aristotle's Poetics. It is quite certain that the ideas that preoccupy Cavafy in the Ars Poetica had been on his mind for a period of years. However, the Ars Poetica is his first prose piece where he gives a systematic treatment to technical and critical issues directly related to the assessment of his work and his role as a poet. In order to project here a clear image of Cavafy's struggle to reach his technical maturity which came after 1910, we need first to discuss the persistent problems he faced during this crucial decade, then to examine the attitudes and values he embodied in certain representative early poems, and finally to relate them to the guiding principles he formulated in his self-addressed poetics of 1903. A number of interrelated problems confronted Cavafy in his late twenties and throughout his thirties. They emerged one by one, to 85 86Philosophy and Literature make more pressing the demand for a consistent solution and a complete recasting of his outlook. Coming to terms with them was extremely difficult. Aside from the emotional and sexual pressures he had to face alone, there was the absence of suitable ideas and conceptual tools to provide him with even the rudiments of an intellectual framework. Whatever he borrowed from Europe and England, or resurrected from his own Hellenic heritage, proved either beyond assimilation or insufficiently digested. The lingering issues fell roughly into four areas. (i) Despite his determination to devote his life to the writing of poetry, the quality of his work was discouraging. He knew this and as a result he often expressed uncertainty about his ability to proceed. Time and again he appeared suffering from a feeling of inadequacy, but nevertheless he sought to engage a reflective mood from which to draw encouragement and hope. (ii) On the theoretical side, he identified with the long tradition which assigned a coveted cultural role to the savant-poet as discloser of truth and spokesman for humanity; this despite the prevailing climate of opinion in his immediate environment which recognized no such high position in his case. Cavafy knew that his standing with the Greek community of Alexandria had gradually dwindled with the loss of family wealth and his lowly employment, and also that his expectations to be respected in his role as a poet and leader in communal affairs were futile. This denial of personal recognition in a society dominated by commerce and finance contributed to his mood of depression. The feeling of being an outcast, despite his associations with the upper social circles of Alexandria, became a constant irritant to his sense of pride. (iii) The course of culture, the destiny of human institutions and the workings of history, became puzzles as he tried to view them through the opaque glass of disillusionment. These were the grand themes actively discussed in the writings of leading European intellectuals, but to the young poet they had a different personal urgency. Ethical corporate marketing—as an organisational-wide philosophy—transcends the domains of corporate social responsibility, business ethics, stakeholder theory and corporate marketing. This being said, ethical corporate marketing represents a logical development vis-a-vis the nascent domain of corporate marketing has an explicit ethical/CSR dimension and extends stakeholder theory by taking account of an institution’s past, present and (prospective) future stakeholders. In our article, we discuss, scrutinise and elaborate the notion of ethical corporate marketing. We argue that an ethical corporate marketing positioning is a (...) prerequisite for corporations which claim to have an authentic ethical corporate identity. Our article expands and integrates extant scholarship vis-a-vis ethical corporate identities, the sustainable entrepreneur and corporate marketing. This paper replies to Peter Millican (Mind, 2009), who argues that Hume denies the possible existence of causal powers which underlie the regularities that we observe in nature. I argue that Hume's own philosophical views on causal power cannot be considered apart from his mitigated skepticism. His account of the origin of the idea of causal power, which traces it to a subjective impression, only leads to what he calls ‘Pyrrhonian scepticism’. He holds that we can only escape such excessive (...) skepticism by way of a natural judgment based on the association of ideas, which forms the basis of what he calls ‘a legitimate ground of Assent’. The complexity of the set of truths of arithmetic is determined for various theories of truth deriving from Kripke and from Gupta and Herzberger.

This paper challenges the recommendation of 1981 President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research that all jurisdictions in the United States should adopt the Uniform Determination of Death Act, which endorses a whole-brain, rather than a higher-brain, definition of death. I argue that the Commission was wrong to reject the "personhood argument" for the higher-brain definition on the grounds that there is no consensus among philosophers or the general population as to what (...) constitutes "personhood". I claim that philosophers agree that some potential for cognitive function is necessary for personhood and that, when this is absent in cases of anencephaly and persistent vegetative state (PVS), the individual should be considered dead. I further argue that the lack of consensus among the general population is due in large measure to misunderstandings about the medical reality of PVS and beliefs influenced by feelings for a specific individual in PVS. I also examine and reject two tutiorist arguments which have been used to support the Commission's position: that the higher-brain definition would threaten the severely senile and severely retarded, and that there are not currently adequate medical techniques for determining when all higher-brain activities have ceased. One textbook may introduce the real numbers in Cantor’s way, and another in Dedekind’s, and the mathematical community as a whole will be completely indifferent to the choice between the two. This sort of phenomenon was famously called to the attention of philosophers by Paul Benacerraf. It will be argued that structuralism in philosophy of mathematics is a mistake, a generalization of Benacerraf’s observation in the wrong direction, resulting from philosophers’ preoccupation with ontology.

One approach to the problem of differentiating a religious from a non- religious ethic would be to formulate a definition of religion that would clearly distinguish between religious and nonreligious traditions; however, a broad definition of religion would include some moral traditions, such as Marxism, commonly thought to be forms of secular humanism. A second approach would argue that some moral beliefs are independent, both in content and justification, of religious convictions; such a set of moral beliefs could be described (...) as a secular version of natural law. This approach would be rejected by those who argue that religious convictions go "all the way down." While the first can be debated by appealing to the heuristic value of various definitions of religion, the second involves familiar issues of moral epistemology. Crowdfunding platforms have revolutionized entrepreneurial finance, with 200 billion dollars expected to be dispersed annually to entrepreneurs and small business owners by 2020. Despite the importance of this growing phenomenon, our knowledge of the dynamics of successful lending-based prosocial crowdfunding and its implications for the business ethics literature remain limited. We use a social responsibility lens to examine whether crowdfunders on a lending-based prosocial platform lend their money based on altruistic or strategic motives. Our results indicate that the dynamics of (...) prosocial lending-based crowdfunding are somewhat consistent with traditional forms of financing. Specifically, despite a prosocial setting in nature, crowdfunders tend to act strategically, positively responding to signals of quality and low risk. Notably, we also find that projects that are high on both financial and social appeal receive the highest average amount of funding. Furthermore, language on the lender’s profile indicating ability to pay is positively related to both funding success and funding amount. Our study contributes to filling the gap in the business ethics literature about the dynamics of lending-based prosocial crowdfunding, and the strategic and altruistic ethical motives that drive lenders in such endeavors. In 1956 Jacques Lacan proposed as interpretation of Edgar Allan Poe's "Purloined Letter" that at once challenged literary theorists and revealed a radically new conception of psychoanalysis. Lacan's far-reaching claims about language and truth provoked a vigorous critique by Jacques Derrida, whose essay in turn has spawned further responses from Barbara Johnson, Jane Gallop, Irene Harvey, Norman Holland, and others. The Purloined Poe brings Poe's story together with these readings to provide, in the words of the editors, "a structured exercuse (...) in the elaboration of textual interpretation. The Purloined Poe reprints the full text of Poe's story, followed by Lacan's "Seminar on 'The Purloined Letter,'" along with extensive commentary by the editors. Marie Bonaparte's and Shoshana Felman's discussions of traditional and contemporary approaches to "psychoanalysing" texts precede Alan Bass's new translation of Derrida's "Purveyor of Truth." The subsequent essays join the Lacan-Derrida debate and offer alternative readings by literary theorists, philosophers, psychologists, and psychoanalysts. The bulk of the material is on topics in philosophy of language, but there are also two papers on philosophy of mathematics written after the appearance of the author’s collected papers on that subject, and one on epistemology. As to the substance of Field’s contributions, limitations of space preclude doing much more below than indicating the range of issues addressed, and the general (...) orientation taken towards them. As to the style of his writing, it well exhibits the first of the two virtues, clarity and conciseness, that one looks for in philosophical prose. (shrink)
